By accessing or using Pheno, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the service.

2. Description of Service

Pheno is a user intelligence platform that connects to your data sources, identifies behavioral patterns, and proposes growth strategies. Features are provided on an as-is basis and may change over time.

3. Your Data

You retain full ownership of your data and your users' data. By using Pheno, you grant us a limited license to process that data solely to provide the service to you. We do not use your data to train models or for any purpose beyond delivering the product.

4. Acceptable Use

You agree not to use Pheno to violate applicable laws, infringe intellectual property rights, harass individuals, or transmit malware. We reserve the right to suspend accounts that violate these terms.

5. Integrations and Third-Party Data

When you connect third-party data sources, you represent that you have the rights and permissions to share that data with Pheno. You are responsible for complying with the terms of service of any connected platforms.

6. Pricing and Billing

Pricing details are available on the Pricing page. All fees are billed in advance and are non-refundable except where required by law. We may update pricing with 30 days notice.

7. Limitation of Liability

To the fullest extent permitted by law, Pheno is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid in the previous 12 months.

8. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will cease and your data will be deleted within 30 days in accordance with our Privacy Policy.

9. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
